Terms
Terms of use
1. Purpose
These terms of use (“Terms”) define the conditions of access to and use of the Orekio service, a digital logbook designed to facilitate therapeutic follow-up between a practitioner and their patient. Orekio is not a medical device within the meaning of Regulation (EU) 2017/745 (see the About page).
2. Access to the service
Practitioners create their own account. They declare their professional title, accept these Terms and confirm their email address. Two-factor authentication is offered to them. They warrant that they lawfully practise the declared profession; Orekio may ask for proof.
Practitioners access the service by subscription (see the Pricing page). The service is offered to them as professionals.
Patients do not sign up alone: they access the service on their practitioner's invitation, free of charge. They can stop sharing their entries at any time. The safety plan built together and the consultation notebook remain visible to the practitioner.
When the patient is a minor, the practitioner obtains the required consents from the patient and from the holders of parental authority before inviting them.
3. User obligations
The practitioner agrees to use Orekio solely as part of genuine therapeutic follow-up and with their patient's consent. Orekio does not replace the patient's record, which the practitioner keeps in line with their professional obligations. The patient agrees to provide truthful information.
Everyone keeps their credentials confidential, uses only their own account and tells Orekio without delay if they suspect unauthorised access (contact@orekio.app).
The following are prohibited: accessing a person's data without the right to do so, circumventing the service's security measures or limits, automated data extraction, copying the service, and any unlawful use.
4. Intellectual property
The service, its brand, and its content remain the exclusive property of Orekio. Data entered by users (sleep diary, scale answers, etc.) remains their property.
5. Liability
Orekio displays the data entered as it is and does not substitute for any medical advice. The practitioner alone judges how to read it and what care decisions to make.
Orekio is not an emergency service: nobody monitors entries in real time, and no entry triggers an alert. The practitioner's bell only reports certain actions, without their content. In an emergency, call 15 or 112; for suicidal thoughts, 3114 (France).
Orekio uses reasonable means to keep the service available and secure, without guaranteeing continuous availability: maintenance or an outage may interrupt it. On the phone, patients can keep making entries offline.
Orekio is liable for its failures under ordinary law. Towards the practitioner, its liability is limited to direct and foreseeable damage. Nothing in these Terms excludes Orekio's liability for gross negligence or wilful misconduct, or where the law forbids limiting it. Neither party is liable for a failure caused by force majeure (Article 1218 of the French Civil Code).
6. AI assistant
For practitioners, in the web app, the service includes an AI assistant that helps with using Orekio: it explains the app and how a score is calculated, guides step by step, offers to open a screen and prepares certain actions.
The assistant is configured and filtered to give no clinical advice, interpret no data and recommend no module. Its answers may contain errors; clinical judgement remains the practitioner's.
No action prepared by the assistant is saved until the practitioner clicks “Confirm”. The practitioner remains responsible for the actions they confirm.
The practitioner agrees not to describe in the assistant any clinical situation or any health data. To prepare an action, they may refer to a patient by full name or alias, which Orekio removes from the question.
The number of questions is limited. The assistant may be suspended at any time.
The processing of data related to the assistant is described in the privacy policy.
7. Term and termination
These Terms apply for as long as the account exists.
Patients can delete their account and data at any time (see the Account deletion page).
Practitioners can cancel their subscription at any time from the app, effective at the end of the paid period. They can ask for their account to be closed by writing to contact@orekio.app.
Founders offer: the first 100 practitioners to sign up, on Zelai or Mendi, get 2 free months without a bank card. A seat is taken when the email address is first confirmed, while seats remain. At the end of these 2 months, without a subscription, the account becomes read-only. The Founders rate stays reserved for 30 more days; after that date without a subscription, it is lost for good, with no effect on the data. A lost seat is not reassigned. From the first payment, the rate is kept for life, including after cancellation. This rate applies to a single-seat subscription: adding a seat moves the subscription to the public rate, for good.
Referral: a practitioner on a trial or subscription has a referral code to share. When a practitioner signs up with this code, the referrer and the referred practitioner each receive a credit worth one month of their own plan, upon the referred practitioner's first payment. This credit comes off subsequent payments. It does not expire, stays on the account after cancellation and applies when the practitioner returns; it is never paid out in cash. The code can be entered until the first payment. A referred practitioner earns credit only once, and two practitioners cannot refer each other. The referrer sees the number of people referred and of credits, never their identity.
At the end of the trial, after cancellation or a final payment failure, the practitioner's account becomes read-only: the data is kept intact, they can read and export it, and they can reactivate their subscription. This freeze lasts 90 days for an account that never paid, and 3 years for a former subscriber. The practitioner is notified before it ends.
When the freeze ends, the practitioner's follow-ups are erased; their account remains, and a new subscription restores access. A patient followed by another practitioner loses their relationship with this one and the modules only this one followed, with their entries; a patient with no practitioner left is erased. A patient whose practitioners are all frozen is told in the app in the 30 days before, and can export their data.
Orekio may suspend or close an account for a serious breach of these Terms, after a warning, except in an emergency or under a legal obligation. Orekio will notify users before any permanent end of the service and give them time to export their data.
8. Personal data
The processing of personal data is described in our privacy policy.
Orekio sells no data and shows no advertising.
9. Governing law
These Terms are governed by French law. In case of dispute, the parties first seek an amicable solution, by writing to contact@orekio.app.
Failing agreement, the dispute falls under the competent French courts. A patient acting as a consumer may bring the matter before the court of their place of residence.
